Optus Mobile Pty Ltd (Optus) has today been ordered by the Federal Court to pay a penalty of $100 million for engaging in unconscionable conduct when selling mobile phones and contracts to hundreds of Australians, and subsequent debt collection in a case brought by the ACCC.
As part of the consent agreement, Optus has undertaken to implement a review of its sales and complaint handling processes. But at this point, promising “we will do better” may not be enough.
Optus has signed an undertaking, accepted by the ACCC, that it will remediate impacted consumers, including by providing compensation. The undertaking sets out further actions the ACCC and Optus have agreed on, including Optus improving its internal systems and processes.
