CESTAT was created to provide an independent forum to hear the appeals against orders and decisions passed by the Commissioners of Customs & Excise under the Customs Act, 1962, Central Excise Act, 1944 and Gold (Control) Act, 1968.

The Customs Excise and Service Tax Appellate Tribunal (CESTAT) was constituted originally as Customs, Excise & Gold (Control) Appellate Tribunal (CEGAT) on under section 129 of the Customs Act, 1962.
